2. OBJECT AND NATURE OF THE SERVICE
MOVIN provides a technological intermediation platform that allows Users to request moving quotes, compare options and contract Services with Collaborating Companies. MOVIN is not the provider of the moving Service. The moving contract is entered into between the User and the Collaborating Company. MOVIN does not transport goods, does not act as a carrier and is not a party to the service-provision contract, except as regards the technology, intermediation and, where applicable, payment routing described in these Terms.
3. ACCEPTANCE OF THE TERMS AND ACCESS TO THE PLATFORM
3.1. Acceptance. Use of the Platform implies full and unreserved acceptance of these Terms, the Privacy Policy and the Cookie Policy. If you do not agree, you must not use the Platform. 3.2. User status. Access as a User requires legal capacity to contract. Minors may not use the Platform. 3.3. Contractual scope. The relationship is governed by these Terms, the Privacy Policy, the Cookie Policy and any specific conditions shown in the booking flow. 3.4. Access and registration. Some features require creating an account with truthful, complete and up-to-date data. The User is responsible for keeping login credentials confidential. 3.5. Technical requirements. The Platform is provided “as available”. MOVIN does not guarantee uninterrupted availability and may carry out maintenance, updates or interruptions for security or operational reasons.
4. REGISTRATION, USER ACCOUNT AND TECHNICAL MEANS
The User undertakes to provide accurate identification and contact data and to keep them updated. MOVIN may suspend or cancel an Account if it detects false data, unauthorised use or a breach of these Terms. The User is responsible for all activity carried out from their Account. MOVIN may require additional verification to prevent fraud.
5. OPERATION OF THE PLATFORM AND CONTRACTING PROCESS
The User may request a quote by providing origin and destination, dates, access details and images of the goods. The Platform may generate an automated quote and show offers from Collaborating Companies. Acceptance of a quote and confirmation of the Service create a contract between the User and the selected Collaborating Company, under the conditions shown before confirmation. MOVIN may facilitate digital signature, documentation and payment collection as a technical intermediary.
6. PHOTOGRAPHS, DATA PROVIDED BY THE USER AND AUTOMATED SYSTEMS
The User authorises MOVIN to process images and data provided to generate inventories, volumes and quotes through automated systems, including artificial intelligence. The User warrants that they have the right to provide those images and that they do not include unnecessary third-party personal data. Automated estimates are indicative and may be reviewed by the Collaborating Company. The User must provide complete and truthful information; incomplete or inaccurate data may lead to price or scope adjustments.
7. QUOTES, SCOPE OF THE SERVICE AND PRICE ADJUSTMENTS
Quotes are based on the information and images provided. If on the day of the Service the actual volume, access, inventory or conditions differ materially from those declared, the Collaborating Company may propose an adjustment or decline to perform the Service under the original conditions, informing the User. Additional services (packing, dismantling, storage, special items, permits) are only included if expressly stated in the quote.
8. ECONOMIC CONDITIONS, PAYMENTS AND INVOICING
Prices are shown in euros unless otherwise indicated and may include applicable taxes as displayed in the booking flow. Payment may be collected through the Platform or as indicated in the confirmation. MOVIN may collect amounts on behalf of the Collaborating Company and settle them according to the commercial relationship with that company. Invoices for the moving Service are issued by the Collaborating Company unless otherwise stated. Failure to pay may result in cancellation of the booking.
9. BOOKING, DATES, CHANGES AND CANCELLATIONS
The booking is confirmed when the User accepts the quote and completes the required payment or deposit. Date changes are subject to the Collaborating Company’s availability and may involve extra cost. Cancellations are governed by the conditions shown before confirmation and by the selected company’s terms. The User will see the applicable cancellation rules before confirming.
10. RIGHT OF WITHDRAWAL
Where consumer law grants a right of withdrawal, it will apply as indicated in the pre-contractual information. The right of withdrawal may not apply to services fully performed, or whose performance has begun with the User’s express consent and acknowledgement of loss of the right, in the terms of applicable consumer legislation. To exercise withdrawal where it applies, the User must notify MOVIN or the Collaborating Company through the channels indicated in the confirmation, within the legal period.
11. PERFORMANCE OF THE SERVICE AND INCIDENTS
The Collaborating Company is solely responsible for performing the Service with due diligence, including handling, transport, delivery and any damage arising from the move, subject to its insurance and terms. The User must allow access, be present or represented at origin and destination, and declare special or high-value items. Incidents must be notified as soon as possible through the Platform or the contacts provided. MOVIN may help channel the incident but is not the insurer or the carrier.
12. USER OBLIGATIONS
The User undertakes to use the Platform lawfully; not to provide false, incomplete or misleading information; not to upload unlawful or third-party content without authorisation; to pay the agreed amounts; to cooperate in performance of the Service; and not to use the Platform to harm MOVIN, Collaborating Companies or other Users. MOVIN may suspend access in case of breach, fraud or security risk.
13. USER CONTENT, INTELLECTUAL PROPERTY AND LICENCE
The Platform, trademarks, software, algorithms and content owned by MOVIN are protected by intellectual and industrial property rights. The User is granted a limited, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms. The User retains rights in images they upload and grant MOVIN a licence to process them solely to provide the services (inventory, quote, operations and legal compliance). The User must not copy, reverse-engineer, scrape or exploit the Platform beyond authorised use.
14. PERSONAL DATA PROTECTION
Processing of personal data is governed by the Privacy Policy available on the Platform. By using the Platform the User acknowledges having read that policy. Collaborating Companies that receive data to perform the Service act as independent controllers for that processing.
15. MOVIN’S LIABILITY AND LIMITATIONS
MOVIN is liable for providing the technological Platform with reasonable diligence. MOVIN is not liable for the quality, punctuality or result of the moving Service, which is the exclusive responsibility of the Collaborating Company. Automated quotes are estimates based on the data provided; MOVIN does not guarantee that they match the final conditions of the physical Service. To the extent permitted by law, MOVIN is not liable for indirect damage, loss of profit, or damage caused by force majeure, User misuse, or third-party failures (networks, payment providers, Collaborating Companies). Mandatory consumer rights remain unaffected.
16. SUSPENSION, BLOCKING AND TERMINATION
MOVIN may suspend, block or terminate access to the Platform in case of breach of these Terms, fraud, security risk, legal requirement or prolonged inactivity. The User may close their Account by requesting it through the contact channels. Termination does not affect obligations already accrued (payments, Services in progress or claims).
17. ELECTRONIC COMMUNICATIONS AND USER SUPPORT
The User agrees to receive operational and contractual communications related to the Platform and booked Services by electronic means. For queries: the contact details published on the Platform and rgpd@usemovin.com for data-protection matters.
18. MODIFICATION OF THE TERMS AND CONDITIONS
MOVIN may modify these Terms. The current version will be published on the Platform with the update date. Material changes will be communicated to Users by reasonable means. Continued use of the Platform after the changes take effect implies acceptance, except where applicable law requires express consent.
19. PARTIAL INVALIDITY AND NO WAIVER
If any clause is held invalid or unenforceable, the remaining clauses will remain in force. Failure by MOVIN to exercise a right does not constitute a waiver of that right.
20. LANGUAGE, GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION
These Terms are provided in English for Users accessing the English version of the Platform. The original legal relationship with MOVIN is governed by Spanish law. For consumers, this is without prejudice to mandatory rights in their country of residence. Unless mandatory law provides otherwise, the parties submit to the courts of Barcelona, Spain. Consumers may also use the European Online Dispute Resolution platform where applicable.
