8.- Users’ rights

Users have the right to access their personal data; request rectification of inaccurate data; request erasure; request restriction of processing; object to processing; request portability; and not to be subject to decisions based solely on automated processing. These rights may be exercised by emailing rgpd@usemovin.com stating the reason for the request, or by post to Calle Montseny 311, CASA 5, 08329 Teià, Barcelona (Spain). The communication must include the User’s full name and a specific request. Without prejudice to any other administrative remedy or court action, the User has the right to lodge a complaint with a Supervisory Authority, in particular in the Member State of habitual residence, place of work or place of the alleged infringement, if they consider that processing of their personal data does not comply with the rules or their rights have not been satisfied.

9.- Data security

MOVIN has taken all measures within its reach to prevent data being used improperly, allowing access only to authorised staff. MOVIN maintains adequate security for the protection of personal data in accordance with applicable law and has established all technical means within its reach to prevent loss, misuse, alteration, unauthorised access and theft of data provided by the User through the Platform, without prejudice to informing you that internet security measures are not impregnable. MOVIN undertakes to comply with the duty of secrecy and confidentiality regarding personal data in accordance with applicable law. MOVIN will not be liable for damage that may arise from the User’s failure to comply with this obligation.

10.- Transfers to third parties

MOVIN informs the User that personal data may be communicated to third parties only when necessary for the correct provision of the requested services or in compliance with applicable legal obligations. In particular, data may be communicated to moving-service providers so they can carry out the contracted service. That communication is necessary to perform the contractual relationship. Once they receive the data, those companies act as independent controllers. Data may also be processed by MOVIN service providers such as financial entities, payment gateways, technology or hosting providers, in which case those third parties act as processors following MOVIN’s instructions under the corresponding data-processing contracts. In all cases MOVIN guarantees that only the data strictly necessary for each purpose are communicated, applying minimisation, confidentiality and appropriate technical and organisational measures. If certain providers process data outside the European Economic Area, MOVIN will ensure those transfers are made with the appropriate safeguards provided in applicable law, such as European Commission adequacy decisions, standard contractual clauses or equivalent mechanisms. User data will be processed exclusively for the purposes described in this Privacy Policy and will never be communicated to third parties for commercial or advertising purposes without the User’s prior express consent.

11.- Changes

MOVIN reserves the right to revise its Privacy Policy whenever it considers it appropriate. Please check this Privacy Policy regularly to read the most recent version. Any change to this Privacy Policy will be communicated to the User.

12.- Links to websites

The MOVIN Platform may include links to third-party websites, such as companies, platforms or external entities. MOVIN is not responsible for how those entities manage Users’ privacy and personal data. We recommend that the User carefully review the privacy policies and terms of use of any external website accessed through Platform links, as their conditions may differ from those established by MOVIN. Including these links does not necessarily imply MOVIN’s approval, supervision or responsibility for the content, services or privacy policies of the linked pages.

13.- Automated processing and artificial intelligence

MOVIN uses automated tools based on artificial intelligence to analyse images and media files provided by the User in order to generate initial automated estimates of the volume, characteristics and approximate cost of the moving service. This processing is based on automated processes that extract technical information from elements captured in the images, without in any case involving the direct identification of natural persons. The purpose is to improve service accuracy, optimise the User experience and make quotes faster. This processing does not produce significant legal effects or similarly significantly affect the User’s rights beyond an indicative estimate of the requested service. In certain cases these estimates may be subject to human review. MOVIN will not take decisions based solely on automated processing that produce legal effects concerning the User or similarly significantly affect them, except with applicable legal safeguards. MOVIN adopts technical and organisational measures so that automated processes follow data minimisation, purpose limitation and information security. MOVIN may process images of the interior of the User’s home or of the goods to be moved. These images may reflect information about personal objects or characteristics of the User’s environment, so MOVIN applies reinforced security and confidentiality, recommending that uploaded content be limited to what is strictly necessary and that documents, faces or third-party personal information be avoided where not needed. Images are used exclusively to generate the inventory and quote, to carry out the move correctly, and to improve the Platform as set out in this Policy. They are accessible only to MOVIN technical administrators and authorised staff of moving-service providers to the extent necessary to provide the service. They will never be used for other purposes or communicated to third parties unrelated to the service without the User’s prior consent. Images are kept for the time strictly necessary to provide the contracted service and manage possible incidents. In general they will be deleted or anonymised once the moving service has ended and the period needed to manage associated claims or liabilities has elapsed.
